Outdoor Structure & Shed Assembly Addendum and Work Authorization

This Outdoor Structure & Shed Assembly Addendum and Work Authorization (“Addendum”) supplements the Terms of Service of Furniture Assembly Pros of NC, a service brand operated by Red-Snake Technology LLC (“Company,” “we,” “our,” or “us”).

This Addendum applies when the Company is asked to assemble outdoor structure kits, shed kits, greenhouse kits, gazebos, canopies, pergolas, screen houses, freestanding outdoor furniture kits, outdoor storage kits, or similar outdoor kit products described below.

Acceptance before work begins. By requesting outdoor kit assembly, confirming an appointment for outdoor kit work, authorizing the Company to begin outdoor assembly, checking the outdoor-addendum consent box on a quote or booking form, or otherwise expressly accepting this Addendum, you agree to this Addendum. Acceptance is required before outdoor assembly work begins. Acceptance is not limited to signature of a Service Completion Agreement after work is finished.

If this Addendum conflicts with the general Terms of Service regarding outdoor kit assembly, this Addendum controls for that outdoor work. Job-specific written quotes, Service Orders, invoices, or signed Service Completion Agreements may add further job-specific terms.

1. Covered Products and Services

Subject to a confirmed quote or Service Order, outdoor assembly services under this Addendum may include assembly of customer-supplied kits such as:

Resin, plastic, metal, and fabric shed kits
Gazebos, canopies, pergolas, and screen houses
Greenhouse kits
Freestanding outdoor furniture kits
Outdoor storage kits and similar freestanding outdoor storage enclosures

Only labor and tasks specifically included in the confirmed order, quote, or approved change during the appointment are included. Manufacturer manuals, site conditions, weather, and safety may limit what can reasonably be completed.

2. Excluded Work

Unless separately approved in a written Service Order or other writing and legally permitted, the Company’s outdoor kit services do not include:

Excavation or grading
Gravel, pavers, or similar base-material installation
Concrete, footings, or poured foundations
Foundations, wood platforms, or decks prepared as structural bases
Installation of support posts as a structural or foundation system
Structural carpentry or wood-framed building construction
Electrical, plumbing, gas, fuel, or exhaust work
Engineering, stamped drawings, or code inspection services
Demolition, hauling, trash removal, or product delivery
Structural attachment of the outdoor product to a building, dwelling, or other permanent structure

Structural attachment to a building is excluded unless separately approved in writing and legally permitted. The customer remains responsible for obtaining any required permits, approvals, or professional services outside this Addendum’s scope.

3. Customer Duties

Before work begins, and throughout the appointment as reasonably requested, the customer is responsible for:

Providing the exact product link, manufacturer, model, and the current manufacturer assembly manual or instructions
Providing a complete, undamaged kit with all required packages, parts, and hardware
Providing a manufacturer-approved base or foundation prepared and ready before the appointment
Providing safe and lawful access to the work area, including clearance for parts, ladders, and tools
Confirming that the customer is the property owner or has authority to approve the work on the property
Selecting and approving final placement of the structure or kit
Confirming setbacks, easements, property boundaries, and any placement restrictions
Complying with HOA rules and obtaining any required permits or governmental approvals
Disclosing known utilities, underground lines, slopes, drainage issues, soft ground, overhead hazards, and other site hazards
Keeping children, pets, and bystanders away from the active work area

The Company is not responsible for delays, incomplete work, or unsafe conditions caused by missing kits, incomplete manuals, unprepared bases, inaccessible sites, or inaccurate information supplied by the customer.

4. No Engineering, Base, Code, or Suitability Warranty from Starting Work

The Company’s start of assembly, presence on site, or partial progress does not constitute:

An engineering opinion
Approval that the customer’s base, pad, platform, or surface meets manufacturer or code requirements
Code approval, permitting approval, or HOA approval
A warranty that the chosen location is suitable, level, drained, load-bearing, or free of hazards

The customer remains solely responsible for site selection, base preparation, permits, and compliance with manufacturer instructions and applicable local requirements.

5. Anchoring — Special Rule for Outdoor Structures

Many outdoor kits require manufacturer-specified anchoring for wind resistance and safety. Anchoring is included only when it is within the approved scope, can be completed safely with the available kit hardware and site conditions, and is authorized for that job.

If manufacturer-required anchoring is outside the approved scope, cannot be safely completed, or is declined by the customer, the Company may:

Refuse to begin assembly
Suspend work in progress
Decline to leave the structure assembled

The customer must not use or occupy an incomplete or unanchored outdoor structure. An incomplete or unanchored outdoor structure may tip, shift, collapse, or become airborne and may cause property damage, serious injury, or death.

Unlike certain indoor wall-anchoring situations described in the Terms of Service, the Company does not offer a simple “decline anchoring and accept all risk” option for outdoor structures covered by this Addendum. Outdoor kit assembly that cannot be properly anchored within approved scope and safe conditions may be refused, suspended, or left incomplete as described above. Authorized labor already performed remains payable as set out in the Terms and any Service Order.

6. Weather and Site Safety

The Company may postpone, suspend, or stop outdoor work because of rain, lightning, high wind, extreme temperatures, wet or unsafe surfaces, or other conditions that reasonably impair safe work.

Safety-based postponement or rescheduling is not a breach of contract by the Company
The Company will attempt to notify the customer using the contact information provided

7. Product Warranties and Company Workmanship

The Company does not manufacture or sell the outdoor kit unless expressly stated in writing. To the maximum extent permitted by law, product warranties, structural performance claims, weather ratings, and material defects remain with the manufacturer, seller, or retailer.

To the extent permitted by applicable law, the Company does not warrant third-party kit quality, lifespan, or continued manufacturer warranty coverage after assembly.

Nothing in this Addendum excludes or limits the Company’s liability for its own work to the extent such exclusion or limitation is prohibited by applicable North Carolina law. Non-waivable consumer rights remain available. Where liability may lawfully be limited, limitations in the Terms of Service apply to outdoor services under this Addendum.

8. Generator Storage Enclosures

When the product is a generator storage enclosure or similar outdoor storage kit, the Company’s service is limited to assembly of the storage enclosure kit as a physical structure.

No electrical work
No fuel-system work
No exhaust, ventilation, or emissions work

Assembly of an enclosure does not determine whether it is safe or lawful to operate a generator inside or near the enclosure. The customer is solely responsible for manufacturer instructions, clearances, carbon monoxide safety, local codes, and safe generator operation.

9. Swing and Glider Kits

Covered swing services are limited to freestanding swing and glider kits assembled on the ground according to the manufacturer’s freestanding design.

Ceiling, porch, tree, beam, or other structural hanging installations are excluded unless separately approved in writing and legally permitted. The Company does not evaluate structural capacity of trees, porches, or building members unless that evaluation is expressly included in a separate written agreement.

10. Notice and Opportunity to Cure

The customer should promptly report visible concerns about outdoor assembly workmanship.

Provide the Company a reasonable opportunity to inspect the disputed work
Do not allow third-party alteration, repair, disassembly, or relocation of the disputed work before the Company inspects, except when immediate action is reasonably necessary for emergency safety to prevent injury or additional property damage

For a verified workmanship issue within the Company’s scope, the Company may, at its option and subject to non-waivable rights under applicable law:

Repair the affected work
Reperform the affected service
Refund a portion of the amount paid for the affected service

This section does not waive any right that cannot lawfully be waived.

11. Changes in Scope or Price

Significant changes to outdoor scope or price require customer authorization in writing or by a retained electronic message (including email, SMS, or other retained messaging reasonably used for the job). The Company will not add payable outdoor work as “minor incidental actions” without customer consent.

The technician is not required to perform outdoor work outside the original order when there is insufficient time, equipment, information, weather window, or safe access.

12. Relationship to Other Documents

This Addendum works together with:

The Company’s Terms of Service
The Company’s Privacy Policy
Any confirmed quote, Service Order, invoice, or signed Service Completion Agreement for the specific job

Collection and use of personal information are described in the Privacy Policy.

13. Governing Law

This Addendum is governed by the laws of North Carolina, without regard to conflict-of-law principles. Before filing a claim, the parties are encouraged to make a reasonable good-faith effort to resolve the issue directly. To the extent permitted by applicable law, the parties consent to venue in Wake County, North Carolina.

This Addendum does not require arbitration, class-action waiver, or jury-trial waiver.

14. Severability

If any provision of this Addendum is found invalid or unenforceable, the remaining provisions will continue in effect.
